Check before you sign

Signing a clean CMR is evidence that the goods arrived in apparent good condition. Where damage or shortage is visible, record it on the note before signing — specifically, not as a general note that the load was received unexamined. A signature with no reservation makes a later claim much harder, because you have documented that nothing appeared wrong.

Time limits for damage that is not obvious

Visible damage must be noted at delivery. Damage that is not apparent on inspection can normally be notified within a short period after delivery, set by the Convention, and missing that window weakens the claim considerably. Where goods are received into a warehouse and opened days later, someone needs to know that clock is running.

Rights that pass to the consignee

Once the goods arrive and this copy is delivered, the consignee generally acquires the right to require delivery and to bring a claim against the carrier in their own name. Before that point those rights sit with the sender. It is the practical reason this copy travels with the load rather than being sent ahead.

+What happens if I sign the CMR without checking?

You have provided evidence that the goods arrived in apparent good order. A claim for visible damage afterwards is much harder to sustain, because the signed note contradicts it.

+How should I record damage on the note?

Specifically. Three cartons crushed, one pallet water damaged is useful; received unchecked is not, and is often treated as no reservation at all. Photograph the damage and the note together.

+How long do I have to claim for hidden damage?

The Convention allows notice within a short fixed period after delivery for damage not apparent on inspection. Check the current period for your route, and treat it as running from delivery rather than from discovery.

+Can I refuse the delivery?

You can refuse to accept goods that are substantially damaged, but doing so has commercial consequences and the carrier will seek instructions. Recording reservations and accepting the goods is usually the better route, and it preserves the claim.
